Austrian Airlines counts as an EU/EEA airline, so these rules can apply both to flights departing the EU/EEA and to flights into the EU/EEA that Austrian Airlines operates. The route and the actual operating carrier always decide a specific case.

How EU261 applies to Austrian Airlines

Austrian Airlines is a Community air carrier, and flights it operates therefore come within the scope of Regulation (EC) No 261/2004 both on departure from the EU/EEA and on flights from a third country into the EU/EEA. In each individual case the decisive factors are the route and which company actually operates the flight as the operating air carrier, not the company from which the ticket was bought.

Who operates the flight

Austrian Airlines belongs to the Lufthansa Group's Passenger Airlines segment. The Lufthansa Group has a wet-lease agreement with airBaltic under which up to 21 Airbus A220-300s are deployed at the group's hubs with airBaltic aircraft and crew (extended by three years from the summer of 2025); flights within the Lufthansa Group may therefore be performed by airBaltic with its own aircraft and crew, and it is then the operating carrier that determines whom an EU261 claim is directed at.
