Wizz Air counts as an EU/EEA airline, so these rules can apply both to flights departing the EU/EEA and to flights into the EU/EEA that Wizz Air operates. The route and the actual operating carrier always decide a specific case.

How EU261 applies to Wizz Air

Wizz Air Hungary is an EU/EEA air carrier, which means that Regulation (EC) No 261/2004 normally covers both flights departing from the EU/EEA and flights from a third country into the EU/EEA where Wizz Air Hungary is the operating air carrier. The route and the operating air carrier are nonetheless decisive in each individual case. Flights operated by Wizz Air UK are normally covered by EU261 only when they depart from the EU/EEA.

Who operates the flight

Wizz Air sells under a single brand, but its flights are operated by different group companies: Wizz Air Hungary Ltd. (Hungary), Wizz Air Malta Limited (Malta) and Wizz Air UK Ltd. (United Kingdom). Wizz Air's website states "This flight is operated by Wizz Air Hungary/Wizz Air UK" and the like. For EU261 purposes the operating air carrier is decisive: flights operated by Wizz Air UK are normally covered by EU261 only on departure from the EU/EEA; UK261 applies separately.

More about Wizz Air

According to the Wizz Air help centre, claims under Regulation (EC) No 261/2004 are submitted through the airline's online complaints form, and the airline states it will respond within 30 days. According to Wizz Air, it does not process claims from a third party unless the passenger has first submitted a claim directly to the airline. For delays, Wizz Air says its ground handling agents provide refreshment or meal vouchers proportionate to the wait and two free phone calls (from two to four hours depending on distance, and at five hours at the latest regardless of distance). If departure moves to the following day, the airline says it arranges hotel accommodation and transport, or reimburses their cost within a reasonable amount, and that receipts should be kept. For a cancelled flight, Wizz Air says passengers who arrange their own alternative transport should first contact its ground handling agents, and that unreasonably priced options are not reimbursed. The airline refers to the National Enforcement Body for the country of departure. According to Wizz Air, its group includes Wizz Air Hungary, Wizz Air UK and Wizz Air Malta, and it names the Hungarian Civil Aviation Authority (Légügyi Felügyeleti Hatósági Főosztály) as its supervisor, so check which group company operates your flight.
