LOT Polish Airlines flight compensation: delayed or cancelled

LOT Polish Airlines counts as an EU/EEA airline, so these rules can apply both to flights departing the EU/EEA and to flights into the EU/EEA that LOT Polish Airlines operates. The route and the actual operating carrier always decide a specific case.

LOT is a Community air carrier licensed in Poland, so flights on which LOT is the operating air carrier are normally covered by Regulation (EC) No 261/2004, both on departure from the EU/EEA and on arrival in the EU/EEA from a third country. The route and the carrier actually operating the flight are, however, decisive in each individual case: under a code-share or a wet lease it is the operating air carrier, not the marketing carrier, that is responsible under the Regulation.

LOT's help centre says its contact centre can be reached around the clock in Polish and English, and that the airline also offers Messenger, WhatsApp and forms for cases. LOT describes Warsaw Chopin as its hub. For cancelled flights, LOT states that the ticket can be changed at no extra cost within plus or minus 7 days of the original travel date, that only one free change is possible, and that you can either rebook yourself or accept the alternative the airline offers. According to the Polish civil aviation authority ULC, under Polish consumer law an airline must answer a complaint within 30 days, and passengers can also pursue claims in a civil court. ULC further states that the competent authority is determined under Article 16(1) of Regulation (EC) No 261/2004, and that a delay is counted as three hours or more on arrival, following the Court of Justice's judgment in Case C-402/07.
