Eurowings counts as an EU/EEA airline, so these rules can apply both to flights departing the EU/EEA and to flights into the EU/EEA that Eurowings operates. The route and the actual operating carrier always decide a specific case.
How EU261 applies to Eurowings
Eurowings is a Community air carrier, which means that Regulation (EC) No 261/2004 normally applies both to flights departing from the EU/EEA and to flights from a third country into the EU/EEA where Eurowings is the operating air carrier. Whether the Regulation applies in an individual case always turns on the route and on which company actually operated the flight, not on the brand shown on the ticket.
Who operates the flight
Eurowings' conditions of carriage (clause 9.2.1) reserve the right, in exceptional cases, to have a flight operated by another airline on Eurowings' behalf (wet lease).
More about Eurowings
Eurowings states in its FAQ that response times on claims can occasionally take longer than the airline would like, and that after two months without a reply at the earliest you can turn to an arbitration service. According to Eurowings, a claim is always directed to the airline that actually operated the flight. On delays, the airline says vouchers are issued after at least two hours on short-haul flights, three hours on medium-haul and four hours on long-haul, and if no catering is available on site Eurowings asks you to keep receipts and states that it reimburses 30 euros per person per day. If a delay or rebooking means you cannot continue until the next day, Eurowings says it provides a hotel room, and as a fallback states that it reimburses the receipted cost of a mid-range hotel up to 150 euros per person. For domestic flights cancelled at short notice the airline says it can offer a rail voucher. Eurowings describes itself as a subsidiary of Lufthansa with 13 international bases, and in its legal information it names a German conciliation body for travel and transport (Schlichtungsstelle Reise & Verkehr).
