Swiss is based in Switzerland, which is not part of the EU/EEA. Under the EU–Switzerland air transport agreement, however, the EU261 passenger-rights rules also apply in Switzerland. Whether a specific flight is covered depends on the route and on which airline actually operates it.

How EU261 applies to Swiss

Swiss is based in Zurich, Switzerland, which is not part of the EU/EEA. Under the EU–Switzerland air transport agreement, however, EU261 also applies in Switzerland. Whether a specific flight is covered depends on the route and on which airline actually operates the flight; not every Swiss flight is automatically covered.

Who operates the flight

Parts of the Swiss European network are operated by Helvetic Airways under a long-term wet lease agreement: according to Swiss's own press release of 1 October 2024, up to 15 Embraer E190/E195 aircraft (a partnership in place since 2007, now extended by a further five years). Under Regulation (EC) No 261/2004 it is the operating air carrier that is liable, and on these flights that may be Helvetic Airways.
