Transavia counts as an EU/EEA airline, so these rules can apply both to flights departing the EU/EEA and to flights into the EU/EEA that Transavia operates. The route and the actual operating carrier always decide a specific case.

How EU261 applies to Transavia

Transavia (Transavia Airlines C.V. in the Netherlands and Transavia France S.A.S. in France) is an EU/EEA air carrier, which means that Regulation (EC) No 261/2004 normally applies both to flights departing from the EU/EEA and to flights into the EU/EEA, provided that Transavia (Airlines C.V. or France S.A.S.) is the operating air carrier on the flight concerned. Whether the Regulation applies in an individual case always turns on the route and on the operating air carrier, not on where the ticket was bought or which carrier marketed the flight.

Who operates the flight

Transavia's official Regulation (EC) No 261/2004 notice states that flights whose flight numbers begin with "HV" are operated by Transavia Airlines C.V. (the Netherlands) and that flights beginning with "TO" are operated by Transavia France S.A.S. (France).

More about Transavia

According to Transavia's help centre, you receive an email and text message if your flight is delayed by 45 minutes or more, and you should report to the handling staff at the airport. For delays of two hours or more, Transavia says you are entitled to care, in the form of an allowance for a drink and/or meal and, if needed, accommodation with transport. For delays of five hours or more you can, according to the airline, cancel your ticket free of charge. Transavia says compensation and expenses are claimed through its claim form, including when the booking was made through a travel agency. The Dutch inspectorate ILT says complaints and claims should be submitted to the airline and that its aviation authority does not handle individual compensation claims, but can take measures against airlines, such as fines.
