ITA Airways counts as an EU/EEA airline, so these rules can apply both to flights departing the EU/EEA and to flights into the EU/EEA that ITA Airways operates. The route and the actual operating carrier always decide a specific case.
How EU261 applies to ITA Airways
Italia Trasporto Aereo S.p.A. (the ITA Airways brand) is based in Rome. According to the airline's passenger-rights page, Regulation (EC) No 261/2004 applies to passengers departing from an airport in an EU Member State, or from a third country to an EU Member State provided the flight is operated by an EU carrier, and it is the operating air carrier that must uphold the rights. The route and the carrier actually operating the flight are nevertheless always decisive in the individual case. Flights marketed under the ITA Airways brand but operated by another carrier are assessed against the status of that operating carrier.
More about ITA Airways
ITA Airways is the brand of Italia Trasporto Aereo S.p.A., based in Rome. On its passenger-rights page the airline says the operating carrier must uphold rights under Regulation (EC) No 261/2004 and that claims can be made through an online form. It states that significantly delayed passengers are entitled to meals, refreshments and, where necessary, hotel accommodation, and to a refund after delays of more than five hours. It describes itself as 59% owned by Italy's Ministry of Economy and Finance and 41% by Deutsche Lufthansa AG. Italy's civil aviation authority, ENAC, says passengers should complain to the airline first and may go to ENAC if there is no reply after six weeks or the answer is unsatisfactory.
